You acknowledge that the Service is a free, public-access forum established to facilitate communication among models, photographers, stylists, makeup artists, and other related professionals in Canada. You acknowledge that the Service may contain statements made by third-party individuals or entities, over which the Provider has no control. YOU AGREE AND ACKNOWLEDGE THAT THE PROVIDER SHALL NOT BE LIABLE FOR THE ACCURACY OR RELIABILITY OF ANY STATEMENT MADE IN THE SERVICE. THE SERVICE IS PROVIDED TO YOU "AS IS" WITHOUT WARRANTY, EITHER EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. You agree that you will not post any unlawful, fraudulent, false, threatening, harmful, abusive, defamatory, vulgar, profane, harassing, obscene, racially, hateful, ethnically, or otherwise objectionable material in the Service, including without limitation any material which encourages or incites conduct that might constitute a criminal offense under Canadian Law, violate the rights of others, or otherwise violate any applicable Local, Provincial, Federal or International Law. You agree that you will not post statements that violate Canadian or International Trademark or Copyright Laws and restrictions in any manner whatsoever. You agree to indemnify and hold harmless the Provider, its agents and its representatives, against any claim that may arise from any material that you post in the Service. Although the Provider may from time to time monitor or review postings in the Service, you acknowledge and agree that the Provider is not under any obligation to do so. The Provider reserves the right to modify any messages posted in the Service as it deems necessary, in its sole and unfettered discretion, without prior notice to the third party who posted the message. This includes, without limitation, the right to edit, delete, or remove portions of a message including links, email addresses, images, or content posted in the Service. You acknowledge and agree that use of the Service is at your own risk. NEITHER THE PROVIDER NOR ITS AGENTS OR REPRESENTATIVES SHALL BE LIABLE TO YOU OR ANY OTHER PARTY FOR ANY LOSS, INJURY OR DAMAGE OF ANY KIND RESULTING FROM YOUR USE OR INAABILITY TO USE THE SERVICE, INCLUDING WITHOUT LIMITATION ANY DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, PUNITIVE, EXEMPLARY OR SIMILAR DAMAGES ARISING OUT OF ANY ACTION TAKEN IN RESPONSE TO OR AS A RESULT OF ANY INFORMATION AVAILABLE IN THE SERVICE. YOU HEREBY WAIVE ANY AND ALL CLAIMS AGAINST THE PROVIDER, ITS AGENTS AND ITS REPRESENTATIVES ARISING OUT OF YOUR USE OF THE SERVICE OR ANY INFORMATION CONTAINED THEREIN. Any communication, content or other information that you post in the Service shall be considered non-confidential and non-proprietary. You agree to assume full responsibility for anything that you post in the Service. You further grant the Provider, its agents and its representatives the right to edit, copy, publish and distribute any information or content you post or transmit for any purpose. You acknowledge that the Provider does not monitor third-party web sites that may be linked within posted messages appearing in the Service. You acknowledge and agree that the Provider shall not be held responsible for the accuracy and/or content of any information that may appear on these third-party web pages. You agree that you will not post sexually explicit content or web links in any form that relate to Adult Content Sites or Pay Sites. The Provider reserves the right to remove any sexually explicit content and/or any references to Adult Content Sites or Pay Sites without prior notice to the posting party. For the purposes of this paragraph, the term "sexually explicit" shall include without limitation images depicting sexual intercourse, erections, or images showing clearly visible genitalia. You acknowledge and agree that the Provider is under no obligation to provide exposure to other web pages, forums, or other third-party services (whether for profit or otherwise) through links or other methods in the Service and that the Provider may remove such links or other methods at it's sole and unfettered discretion, and without prior notice to the posting party. You acknowledge that your voluntary disclosure of personal information in a posted message may result in its collection and used by third parties who are beyond the Provider's control or authority. You further acknowledge that this may result in your receipt of unsolicited messages from these third-parties. You agree that the Provider, its agents and its representatives shall not be held liable for any such use of personal information voluntarily disclosed by you. From time to time, the Provider may develop guidelines regarding the posting of appropriate images, email addresses, content, and links in the Service. You agree to read and adhere to these guidelines, which will be posted on the site. The Provider reserves the right to modify the terms and conditions of this Agreement from time to time without prior notice. In any event, you acknowledge that upon publication of any revised Agreement at this site, you will be deemed to have received proper notice. By your continued use of the Service after publication of the revised Agreement at this site, you hereby agree to adhere to the revised terms and conditions contained therein. This Agreement and any disputes that may arise out of or be related to the Service shall be governed by the Laws of the Province of Ontario.
